Terms of Service

Founder-approved trial decisions
MicroBurst offers a 14-day validation-only Free Trial. Trial access includes platform access only and does not include third-party ad spend, paid media, live distribution, managed campaigns, or guaranteed advertising results.
Live ads, managed campaigns, paid distribution, paid subscription conversion, paid pilots, custom pricing, special support, or other non-standard commitments require separate founder approval and written merchant authorization.
MicroBurst is a separate third-party service from Clover, Square, Toast, Google, Stripe, and other connected providers. Merchants authorize each provider connection separately.
1. Introduction
These Terms of Service govern access to and use of MicroBurst, a merchant-facing promotion intelligence and campaign planning platform.
MicroBurst helps merchants identify promotion opportunities, connect authorized merchant systems, preview campaign ideas, measure outcomes, and understand what moved in their business.
These Terms apply to merchants, business entities, account owners, employees, contractors, and other authorized users who access or use MicroBurst.
2. Acceptance of Terms
You accept these Terms by creating an account, connecting a provider account, using MicroBurst, signing an order form, accepting a pilot agreement, or otherwise indicating acceptance through an approved process.
If you use MicroBurst on behalf of a business, you represent that you have authority to bind that business to these Terms.
If you do not agree to these Terms, you may not access or use MicroBurst.
3. Merchant Accounts and Authorized Users
You are responsible for the accuracy of account information, business information, user permissions, and connected provider information associated with your MicroBurst account.
You are responsible for all activity under your account, including activity by employees, contractors, agencies, or other users you authorize.
You must keep login credentials secure and promptly notify MicroBurst if you believe your account or connected provider credentials have been compromised.
4. Connected Provider Authorization
MicroBurst may allow you to connect third-party merchant systems and services, including point-of-sale systems, ordering platforms, delivery platforms, advertising platforms, payment or billing providers, analytics tools, and other systems supported by MicroBurst.
By connecting a Connected Provider, you authorize MicroBurst to access, process, store, display, analyze, and use the data made available by that Connected Provider according to the permissions, scopes, account roles, and data categories you grant.
You represent that you have the right to connect each Connected Provider and to authorize MicroBurst to use the resulting data.
Connected Providers are not controlled by MicroBurst, and MicroBurst is not responsible for their availability, API changes, policies, account restrictions, data quality, data delays, rate limits, outages, or errors.
5. Merchant Data
Merchant Data means data that you or your authorized users provide to MicroBurst, or that MicroBurst receives from Connected Providers on your behalf.
MicroBurst uses Merchant Data to provide, maintain, secure, improve, and support MicroBurst, including connecting merchant systems, reading authorized catalog and inventory signals, identifying promotion opportunities, generating merchant-specific recommendations, saving campaign drafts, measuring outcomes, and supporting account administration.
MicroBurst does not own your Merchant Data. You retain ownership of Merchant Data subject to the rights you grant MicroBurst in these Terms and any applicable order form, pilot agreement, privacy policy, provider schedule, or data processing agreement.
6. Merchant-local intelligence
MicroBurst's current data posture is merchant-local intelligence. Private merchant data comes in, and merchant-specific recommendations, previews, and reports come out for that same merchant.
MicroBurst may use your authorized catalog, inventory, sales, campaign, advertising, and outcome signals to improve recommendations, reports, and campaign planning for your own business.
MicroBurst does not sell merchant-level confidential POS data.
7. Aggregated intelligence and benchmarks
MicroBurst may develop aggregated intelligence, benchmark, model-improvement, or category-insight features that use patterns across participating merchants or campaigns.
Before Merchant Data is used for cross-merchant benchmarks or aggregated intelligence, MicroBurst should apply appropriate controls such as aggregation, de-identification, normalization, permission controls, filtering to reduce merchant-level leakage, and provider-policy compliance.
MicroBurst will not show one merchant another merchant's raw confidential data and will not publicly identify a merchant, merchant results, screenshots, campaign examples, or case studies without appropriate approval.
8. Campaign recommendations, previews, and validation
MicroBurst may provide recommendations, campaign ideas, promotion templates, message previews, ad previews, validation outputs, and other planning tools.
Recommendations and previews are decision-support tools. They are not guarantees of sales, revenue, profit, store traffic, ad approval, ad placement, ranking, return on ad spend, inventory movement, or customer behavior.
You remain responsible for reviewing and approving any campaign, offer, advertisement, price, discount, message, creative, budget, audience, geography, timing, terms, and legal compliance before use.
9. Advertising and live distribution
Unless a future approved release, order form, or written agreement says otherwise, advertising behavior is validation, preview, planning, or simulation only.
No live Google Ads, Google Maps, social ads, delivery marketplace promotions, or other paid distribution spend is authorized merely by using MicroBurst or accepting these Terms.
If live distribution is enabled in the future, you or MicroBurst, as applicable, must approve the budget, spending cap, channel, geography, duration, campaign content, and any managed advertising terms before spend occurs.
10. Trials, subscriptions, billing, and payment
MicroBurst may offer free trials, pilots, paid subscriptions, usage-based fees, managed services, or other plans described in an order form, checkout flow, pilot agreement, invoice, or pricing page.
Trial access, if offered, is subject to the approved trial duration, feature limits, usage limits, support limits, and conversion terms.
Platform fees are separate from third-party advertising spend, Connected Provider fees, taxes, payment processing fees, and pass-through charges unless an order form or written agreement says otherwise.
11. Merchant responsibilities
You are responsible for maintaining accurate business, product, inventory, price, offer, and account information; reviewing all campaign recommendations, previews, and reports before acting; ensuring you have authority to connect each provider; complying with laws, advertising rules, consumer protection rules, tax rules, privacy obligations, offer disclosures, platform policies, and provider terms; and honoring merchant promises made to consumers.
You may not misuse MicroBurst, interfere with the service, attempt unauthorized access, reverse engineer protected parts of the platform, upload malicious content, violate provider rules, or use MicroBurst for illegal or harmful activities.
12. Third-party services
Your use of Clover, Square, Toast, Google, Stripe, delivery marketplaces, ordering providers, advertising platforms, analytics providers, and other third parties may be governed by their own terms, privacy policies, app marketplace rules, data use policies, and account requirements.
MicroBurst is not responsible for third-party service outages, API changes, data delays, metric discrepancies, policy decisions, credential revocation, rejected campaigns, account restrictions, billing changes, or provider termination.
13. Privacy and data protection
MicroBurst's collection, use, and sharing of personal information is described in the MicroBurst Privacy Policy.
You are responsible for providing any notices and obtaining any consents required from your customers, employees, agents, or users in connection with your use of MicroBurst and Connected Providers.
14. Confidentiality and publicity
MicroBurst and the Merchant may exchange confidential business, technical, financial, product, customer, provider, or operational information.
MicroBurst will not use your merchant name, logo, screenshots, results, campaign examples, or case study materials publicly without appropriate approval.
15. Availability, support, and changes
MicroBurst may modify, suspend, limit, or discontinue features at any time, subject to any commitments in an applicable order form or written agreement.
Beta, pilot, preview, or trial features may be experimental, incomplete, limited, or subject to change.
16. Suspension and termination
You may stop using MicroBurst or cancel according to the applicable subscription or trial terms.
MicroBurst may suspend or terminate access if you violate these Terms, payment fails, your account creates security or legal risk, a Connected Provider restricts access, or MicroBurst is required to do so by law, provider rules, or platform policy.
17. Disclaimers
MicroBurst is provided on an as-is and as-available basis unless a final agreement says otherwise.
MicroBurst does not guarantee that recommendations, campaign previews, advertising metrics, benchmarks, forecasts, or reports will be accurate, complete, uninterrupted, error-free, profitable, or accepted by any third-party platform.
MicroBurst does not guarantee sales, revenue, traffic, customer acquisition, ad approval, ad placement, inventory movement, rankings, conversion rates, cost per conversion, return on ad spend, or business outcomes.
18. Limitation of liability
To the maximum extent allowed by applicable law, MicroBurst's liability is limited according to the applicable approved Terms, order form, pilot agreement, or other written agreement.
MicroBurst is not liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages except where such limitations are not allowed by law.
19. Indemnity
You are responsible for merchant products, services, campaigns, offers, content, misuse of MicroBurst, violations of laws or provider terms, Merchant Data supplied to MicroBurst or Connected Providers, unauthorized provider connections, and consumer claims arising from merchant offers, pricing, fulfillment, refunds, delivery, or advertising claims.
20. Governing law and disputes
Governing law, venue, dispute forum, arbitration, small-claims procedures, informal resolution, class-action waiver, and any other dispute process are governed by the applicable final Terms, order form, pilot agreement, or other written agreement approved for your account.
21. Changes to Terms
MicroBurst may update these Terms from time to time. If changes are material, MicroBurst should provide notice through the product, email, website, or another reasonable method.
Continued use of MicroBurst after updated Terms become effective may constitute acceptance of the updated Terms, subject to the approved acceptance process.
